Terms of service


1. Scope of application

For the business relationship between FRAEND GmbH, Brunnenstr. 42, 10115 Berlin (Super Super Markt) and you as the customer, the following Terms and conditions in the version valid at the time of the order shall apply exclusively.


2. Conclusion of contract

The offers of Super Super Markt are always subject to change. By submitting your order, you submit a binding offer to conclude a contract. Afterwards you will receive an order confirmation by email with all details of your order. However, this email does not constitute a binding acceptance of the contract. The contract of sale is only concluded with the payment (via credit card, PayPal or prepayment) by you and the delivery of the ordered goods.


3. Membership

A membership is valid for one year and is automatically renewed. The membership fee is always charged for a full calendar year. For a membership which is concluded during the year, the full fee is therefore still due. The cancellation of a membership is possible at the end of every month.


4. Supergaben

As stipulated in the statutes of Super Super Markt, all current Supergaben are an exclusive offer: They are created especially for our members. Each member can order only one Supergabe.


5. Prices and shipping costs

The indicated prices include the legal value added tax (VAT) if not indicated otherwise. All indicated prices exclude shipping prices. The shipping prices are calculated based on the size and weight of the goods purchased and are added at checkout. Unless otherwise agreed, the delivery will be made to the address of the customer or to the delivery address indicated by the customer. Information about the delivery time is non-binding, unless the delivery date has been promised bindingly in exceptional cases.


6. Delivery and payment

After receipt of payment, the goods will be shipped to the address of the customer. Super Super Markt does not assume any liability for any damage that may have occurred in the course of the delivery of the goods. The buyer must immediately check the goods for damage and complain to the carrier before accepting them. Should there be obvious damages and only be noticed after acceptance, the buyer must report this to the respective shipping company within 7 days. If the buyer fails to do so, the assertion of complaints for such obvious damage is excluded.


7. Retention of title

The ordered goods remain the property of Super Super Markt or the respective artist until full and final payment has been received.


8. Liability

Super Super Markt shall only be liable if it has violated an essential contractual obligation (cardinal obligation) in a manner that endangers the purpose of the contract or if the damage is due to gross negligence or intent on the part of Super Super Markt. Insofar as this is not due to gross negligence or intent, the liability of Super Super Markt is limited to the damage that was reasonably foreseeable when the contract was concluded.

Liability due to warranted qualities, in the event of personal injury and due to mandatory statutory provisions, in particular the Product Liability Act, remains unaffected.


9. Returns and refunds

Cancelling your order

If you’ve changed your mind shortly after placing an order, you can get in touch with us directly via WhatsApp or email hello@super-super-markt.com.
All requests for cancellations or changes must be made within 24 hours of placing your order. Unfortunately we cannot accommodate any requests made after this time, as the artwork will already have been dispatched to our framing partner or packaged ready to be shipped to your address.

Return policy

If your artwork arrives and doesn’t meet your expectations, or if you receive an incorrect shipment, please contact us via the WhatsApp or email hello@super-super-markt.com as soon as is reasonably possible. In such cases, you will have 14 days to notify us about the problem. Where appropriate, we will be happy to arrange a refund, repair or replacement. Please note that you will not be eligible to claim under this clause if you were made aware of the reason for your claim prior to purchase.

Once your artwork has arrived, you have 14 days to let us know if you're not 100% happy with it and would like a refund. You can get in touch with us at hello@super-super-markt.com.

We are only able to process refunds for artworks returned in perfect condition and in their original packaging, with accompanying documentation enclosed – including the Certificate of Authenticity and any other items within the box where applicable. Artworks must be returned in perfect condition, including in their original packaging and with the Certificate of Authenticity you received with the piece, if applicable. We are unable to accept any returns that are missing their Certificate of Authenticity.

For all returns we arrange a door to door collection, which we will coordinate with you directly following your request. A tracking number will be provided. Please do not book your own courier as this will not be tracked by our system and could mean that your order is not eligible for a refund. Once we have safely received the artwork we will process your refund.  Refunds for returned goods will be made within 14 days of their arrival to our warehouse. All refunds will be issued to the original payment method, and can take 5-10 days to appear in your account. You will be refunded for the price of the artwork, minus a handling fee. The exact amount varies based on size, weight and location. Super Super Markt will not refund any VAT or import charges. In some cases, you may be able to reclaim these costs from your local tax authorities.


10. Warranty, Proper treatment

It is assumed to be known that all works of art, depending on environmental influences, can change their appearance and coloration and fade. Super Super Markt does not assume any guarantee for this unalterable process of change.

Works of art and frames may not be exposed to direct sunlight, either in whole or in part, nor may they be hung directly above heating systems or exposed to humidity levels exceeding those of normal living rooms. Accordingly, works of art and frames are not suitable for outdoor areas, basement rooms, bathrooms and kitchens.


11. No granting of rights, exhibitions

With the purchase of a work of art, you acquire only the real ownership of the work. No other rights of use are granted. Any reproduction (duplication), distribution, renting, making publicly available or other analog or digital exploitation is not permitted. However, you may resell the work.

The public exhibition of acquired works of art requires the consent of the artist concerned in individual cases.


12. Data protection

Super Super Markt uses the data provided by you to fulfill and process your order. Your data will be passed on to the shipping company commissioned with the delivery, as far as this is necessary for the delivery of the goods (name, address, if necessary telephone number to coordinate delivery dates). For the processing of payments, we may pass on your payment data to our house bank.


13. Final provisions

The place of performance and jurisdiction for merchants, legal entities under public law or special funds under public law is Cologne. German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
